Shipping / Order Information
- We cannot ship to P.O. boxes or C.O.D.
- International Orders - Contact Customer Service
- Orders placed after 4pm will be processed the following
business day.
- Orders placed on Saturdays & Sundays will be processed
the following business day.
- Shipments to Alaska and Hawaii allow 1-2 additional business
days for delivery.
- Business Days do not include week-ends or holidays.
- Please allow 1-2 days for standard delivery
- Incomplete information will result in delay of order.
- Prices are subject to change without notice
Unless otherwise noted, shipping and handling costs are calculated
on your total order and will be added at the time of checkout.
Shipments to Michigan: Michigan Sales Tax of 6% will be assessed
on the total order at the time of checkout.
Shipping information for Art:
- All Artwork is shipped insured. All prints are shipped with a foam core backing.
- Allow 4-6 weeks delivery for all framed prints.
- Allow 2-4 weeks delivery for all unframed prints.
- Allow 4-8 weeks for delivery on Original Trophy Portraits.
- Allow 4-8 weeks for delivery on Original Wildlife Paintings.
TimberGear™ Online Shopping Policy
ACCEPTANCE OF AGREEMENT
By engaging to purchase a product on the
Website, you (further know as "Buyer") agree and accept terms
of this Agreement. Contact us if you have any questions
about our products, policies, comments or questions.
PAYMENT OPTIONS:
We accept Visa, Master Card, American
Express, Discover and E-Check. Your purchases will appear as "Timbergear," on
your credit card statement. Timbergear does not accept COD.
If Buyer fails to pay for any products received, Timbergear™
shall reserves the right, to suspend or cancel further delivery,
and to proceed in any court of proper jurisdiction against
Buyer for all amounts due including, but not limited to, attorney
fees, costs and interest. Please make sure that your billing
address is consistent with the address on your credit card
statement billing.
INTERNATIONAL ORDERS:
Please contact Customer Service.
STATE SALES TAX:
For all purchases sales tax will be charged
where it is required by law to charge tax. We will charge State
sales tax applicable for Michigan and is subject to change
accordingly.
SHIPPING:
We ship all orders to the forty-eight contiguous states
United States. Timbergear™ shall use reasonable efforts for products
to be delivered to Buyer, but shall in no event be liable for any
losses or damages caused by delay or non-delivery of products. Buyer
shall be responsible for all shipping charges. Timbergear is unable
to deliver to P.O. Boxes. Please be sure to enter a complete shipping
address for all online orders when completing and submitting your
online purchase.
LIMIT OF NON-DELIVERY CLAIM:
All non-delivery claims related to products sold through
Timbergear's Website shall be made within thirty (30) days after
receipt of the product to which the claim relates. Buyer's failure
to give written notice of any claim within the 30-day period of
time to Timbergear shall constitute an absolute and unconditional
waiver of such claim. In no event shall Buyer commence any action
related to products sold to Buyer through the Website later than
one year after receipt of the product.
RETURNS:
Refunds will be issued within 45 days of purchase. After
the 45-day period, a merchandise exchange will be issued. We offer
an exchange for defective items and Timbergear™ Wear items that are
not of the correct size that has not been worn or laundered. Our
exchange process requires you to return the manufacturer's defective
product for an exchange with a non-defective product.
To return an item for exchange or refund, contact Customer
Service at Timbergear™. Our Customer Service representative
may ask you for your order number and date of purchase. Please
allow up to 14 business days for the exchanged product to be sent
to you.
If the Buyer does not register for a PayPal®
account, Timbergear™ cannot issue credit card or cash refunds,
therefore, an exchange for item(s) purchased will be issued.
For fast, accurate returns, keep the invoice
and packing slip with your shipment. If you need to return
your purchase, please complete and return shipping invoice
and include it with your merchandise. Ship your package postage
paid. Timbergear does not accept postage due packages.
Items purchased through online shopping
cannot be returned at our Retailer store locations that sell
Timbergear™ merchandise.

DAMAGED MERCHANDISE:
If your item is received damaged, contact our Customer Service
Department at 810-240-2843. Be sure to have the packing slip along
with a copy of your purchase invoice to give the information to our
Customer Service Representative.
DEFECTIVE MERCHANDISE:
If for any reason, you item has a manufacturers
defect, it will be replaced at no cost to you. Simply contact
Customer Service at Timbergear™ with your complete order information
and they will direct you on how to return the defective item.
Items that have been deliberately, maliciously damaged or worn
will not be entitled for refund or exchange.
PRICES and AVAILAILITY:
Prices of product on the Website are subject
to change at any time without notice. Product availability
is subject to change at any time. Timbergear™ makes no representations
of warranties regarding product availability.
Timbergear™ does not accept COD orders.
If Buyer fails to pay for any products received, Timbergear™

Buyer for all amounts due including, but not limited to, attorney
fees, costs, interest and any applicable fees imposed.
DISCLAIMER OF WARRANTIES:
SELLER MAKES NO WARRANTY, EXPRESS OR IMPLIED. Buyer is solely
responsible for determining the suitability of the products for the
uses and applications considered by Buyer. Buyer assumes all risks
and liabilities arising out of possession and or use of the merchandise
item(s) purchased.
BUYER'S REPRESENTATION:
Buyer represents that he/she has the requisite power
and legal authority to enter into this Agreement and to perform
the obligations under this Agreement. Buyer represents that
he/she has provided accurate information to Timbergear™ in purchasing
merchandise through the Website and that his/her offer to purchase
products complies with all applicable laws. Buyer acknowledges
and agrees that he/she is solely responsible for compliance
with all applicable laws and regulations concerning Buyer's
purchase, possession and use of the merchandise item(s).
FINAL:
1. No waiver by either party of any breach of any terms
or conditions contained herein shall be construed as a waiver
of any succeeding breach of the same or any other terms or condition
herein. Nothing contained herein shall limit the remedies of
Timbergear™ in the event of Buyer's breach of this Agreement.
2. The parties agree that electronic communications shall be considered "writings" for
all purposes under the law. If notice is not sent by electronic communications,
notices shall be deemed given when delivered to or US mail by first
class postage prepaid, and, if to Buyer, sent to the address as completed
by the Buyer during the checkout period finalizing purchase made through
Timbergear's website.
3. These Terms and Conditions shall be governed by and construed under
the laws of the State of Michigan. Any legal action with respect to
any transaction subject to this Agreement must be commenced within
one year after the cause of action has arisen.
